(“TBC”) as a condition for allowing me, identified above, to participate in any related
activities while serving on a Texas Beef Team. This liability waiver encompasses all
aspects of activities, including but not limited to all trip related travel (both foreign
and domestic) and all team events.
WAIVER AND LIABILITY RELEASE.
AS CONSIDERATION FOR BEING ALLOWED TO ATTEND EVENTS AND PARTICIPATE ON A TEXAS BEEF TEAM,
I AGREE TO ASSUME FULL RESPONSIBILITY OF DAMAGES WHICH I MAY SUSTAIN WHILE PARTICIPATING.
THE TERM “DAMAGES” INCLUDES BUT IS NOT LIMITED TO MEDICAL EXPENSES, EXPENSES OR LOSSES
INCURRED BECAUSE OF BODILY INJURY OR PROPERTY DAMAGES AND/OR PERSONAL PROPERTY DAMAGES.
I AGREE TO INDEMNIFY AND HOLD HARMLESS TBC AND IT RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES,
AGENTS HEIRS, INSURERS, REPRESENTATIVES, ASSIGNS, AND OTHERS ACTING ON THEIR BEHALF, (“RELEASED PARTIES”) AGAINST
ALL NEGLIGENCE CLAIMS, GROSS NEGLIGENCE CLAIMS, PERSONAL INJURY CLAIMS, AND MENTAL ANGUISH CLAIMS AGAINST TBC
FOR ANY CLAIM THAT MAY BE MADE AGAINST IT FOR INJURIES OR DAMAGES SUSTAINED ON THE EVENT
DESCRIBED HEREIN. THIS WAIVER SHALL EXTEND TO ME, MY HEIRS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, ASSIGNS.
GENERAL ASSUMPTION OF RISK.
I agree to be fully responsible for my own safety.
I understand that there are inherent risks associated with all events.
REMOVAL AT EVENT.
I am voluntarily participating in all activities and agree
to abide by the rules and any decisions of any officials. TBC shall have the right,
in its sole discretion, to take any action it deems appropriate during activities,
including but not limited to my removal of from participation.
PHOTOGRAPHIC RELEASE.
I grant full permission to any and all of the foregoing
persons and entities to use or authorize others to use my name and any photographs, videos,
recordings, or any other record of my participation in activities without remuneration, obligation
or liability to me.
MISCELLANEOUS.
Texas law governs this Waiver, Release of Liability, and Indemnity Agreement.
I agree to pay the attorney fees and costs incurred by TBC and the other persons and entities, described
above should I file a lawsuit in breach of this Waiver, Release of Liability, and Indemnity Agreement.
If any clause conflicts with Texas law, only that clause will be null and void but the remainder shall
stay in full force and effect.
I HAVE READ THIS ENTIRE WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT AND ATTEST THAT I FULLY UNDERSTAND
IT INCLUDING THE WAIVER OF ANY SUCH LIABILITIES, DAMAGES, CLAIMS, DEMANDS, OR INJURIES, INCLUDING DEATH, CAUSED
IN WHOLE OR IN PART BY THE NEGLIGENCE, GROSS NEGLIGENCE OR OTHER ACT OR OMISSION OF THE RELEASED PARTIES, OR BY
A PREEXISTING DEFECT.
